Those suffering from from drug abuse issues are also not covered by the ADA.This means that any disabled person who’s indulging in alcohol or substance abuse will not be considered for coverage by the American disabilities act. Employees that from substance abuse issues are regarded as at par with other employees by the law.
However, those employees who are covered by the act have entitlement to categorical benefits by their employers. For example, firms of people covered by the ADA act are supposed to accommodate them in any way they can. This accommodation include flexible timings at office, job sharing, time offs for medical checkups, flexible break periods, and special physical arrangements like an enclosed space for office work etc.
However, while the ADA does make it vital for employers to make provision for their disabled employees,it doesn’t put the employer under any unnecessary pressure. Employers are only asked to make provision for such eventualities providing that it does not affect the business or their personal situation adversely. Thus,consideration is offered if the employer is not able to make the expenditures or faces other problems in providing these entitlements.
One or two factors are regarded as to discern moderately whether the employer is in a position to provide benefits to the disabled employee.These include the company size, the supply of financial resources, the organizational structure, as an example. If the employer is found to be competent in the structural and financial spheres ;it becomes compulsory for him or her to offer the appropriate benefits to workers covered under the ADA act who require them.
